Where the advantage comes from

The Association Agreement between the European Union and Turkey dates from 1963, with an Additional Protocol in 1970 and a further decision in 1980. It covers Turkish employees, Turkish self-employed people, Turkish service providers and their families. Its effect is a standstill: rules that applied to Turkish citizens at the time may be softened later, and tightening them is closed off. That is why some older, gentler rules survive for you while everyone else meets the stricter version.

The four differences that matter

  • The scoring test falls away. Anyone else who wants a residence permit as a business owner is scored by the Netherlands Enterprise Agency on personal experience, business plan and value to the country. For Turkish citizens that scoring system stays out of the assessment entirely.
  • Lower fees apply when you file the application.
  • A lower age requirement applies when you apply for a partner to join you.
  • The approved-employer rule falls away. Dutch employers normally need a formal approval from the immigration service before they may hire skilled staff from outside Europe. For Turkish citizens that requirement is set aside.
  • Free access to work after three years. Once you have worked here for three years, a work permit becomes unnecessary for any employer who hires you.

What still applies

The milder treatment covers the test, rather than the substance. You still register your business with the Chamber of Commerce, you still meet the general requirements that apply to every applicant, and you still show a business plan with financial backing behind it. The permit itself runs for a maximum of two years and is renewable.

The order that works

  1. Decide the legal form and design the structure: a BV (besloten vennootschap, the Dutch private limited company), which is the Dutch private limited company, usually with a holding above it.
  2. Prepare the business plan and the figures that support it.
  3. File the residence application under the agreement, using the dedicated form.
  4. Register with the Chamber of Commerce and open the business account.
